CANCELLATION POLICY

We understand that plans can change and we will gladly assist you in making changes to your order date whenever possible. We accept weekday cancellations by phone or email prior before 12noon, 3 business days before your scheduled delivery date. We reserve the right to charge a cancellation fee if insufficient time is given, as stated above, due to costs incurred in the purchase, priority and preparation of the order.

Please note, cancelled orders cannot be applied to future orders, neither can your order be rescheduled for a later date. We urge you to be very certain of the recipient’s availability before placing an order.

RECIPIENT UNAVAILABILITY

Kindly note that if recipient misses their delivery either by not being reachable, switched off or not taking calls nor responding to text messages and no one is available to receive your order when the driver arrives. We will return the order and resend to you when you’re finally available. We will not be responsible for the quality of food by the time it is finally delivered to you and we will NOT offer a refund. Furthermore, please note that YOU WILL BE RESPONSIBLE for the repeat delivery. Thank you.

ORDER TERMS

By placing an order with us, you will be deemed to have read, understood and agreed to these terms and conditions and also accept that these conditions may be modified or amended and posted on this website from time to time. .

Prices and availability of goods is subject to change without notice.

We take every care to ensure that the description and specification of our products are correct at all time.

9th & Olive Gourmet will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

• to the extent that the website is provided free-of-charge, for any direct loss;
• for any indirect, special or consequential loss; or
• for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if  9th & Olive Gourmet has been expressly advised of the potential loss.

EXCEPTIONS

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit the liability of 9th & Olive Gourmet in respect of any:

• death or personal injury caused by the negligence of  9th & Olive Gourmet or its agents, employees or shareholders/owners;
• fraud or fraudulent misrepresentation on the part of  9th & Olive Gourmet or
• matter which it would be illegal or unlawful for 9th & Olive Gourmet to exclude or limit, or to attempt or purport to exclude or limit, its liability.

INDEMNITY

You hereby indemnify 9th & Olive Gourmet and undertake to keep 9th & Olive Gourmet indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by 9th & Olive Gourmet to a third party in settlement of a claim or dispute on the advice of 9th & Olive Gourmet legal advisers) incurred or suffered by 9th & Olive Gourmet arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
